Terms of Service and License Agreement

The rules for using Luma Owl, written to be read. Sixteen short sections, no surprises.

The short version
  • You get a license to use Luma Owl. We keep ownership of the software.
  • Every LUT, preset, profile and image you create with Luma Owl is 100% yours, to use and to sell.
  • Exported LUTs, presets and profiles always carry a small Luma Owl attribution line in the file, automatically. It does not affect your ownership or your right to sell.
  • Try the whole editor free for 5 days, in the browser or on the Mac, no card needed. Exported images carry a visible watermark, and LUT and preset export wait for Pro.
  • Pro is a license for a set period. One person, up to 2 devices, Mac app included, LUTs and presets without limits. The app checks in online every 28 days.
  • Help us as a beta tester and/or promoting Luma Owl and you get the online version free for a year.
  • 14-day refund while the license is still unactivated. Once it is activated, no refund, since you already tried it free.
  • No reverse engineering, no sharing keys, no reselling Luma Owl itself.
  • Software is provided as is. Scottish law applies.

01Who we are

Luma Owl is made and sold by Di Capitan Ltd, a company registered in the United Kingdom ("we", "us", "Luma Owl"). Luma Owl is a film-grading and LUT-creation application available as a web app at lumaowl.app and as a desktop app for macOS and other platforms.

02The agreement

This page is both an End User License Agreement (EULA) for the software and the Terms of Service for the lumaowl.app website and services. By installing, opening or using Luma Owl, or by purchasing a plan, you agree to these terms.

If you are using Luma Owl on behalf of a company or studio, you confirm you have authority to bind that organisation, and "you" means that organisation.

You must be at least 16 years old to purchase a plan.

03Your license

Luma Owl is licensed, not sold. We grant you a personal, non-exclusive, non-transferable license to install and use Luma Owl for any purpose, including commercial work, under these terms. We keep all ownership and intellectual property rights in the software, its code, its design, its film models and its name.

Your license is tied to you (or your organisation). You may not lend, rent, sublicense, sell or give it to someone else.

Third-party open source components inside Luma Owl keep their own licenses. They are listed on the Licenses page.

04Plans and pricing

5-day trial (browser and Mac app)

There is no permanently free version of Luma Owl. You can try the whole editor for 5 days, in your browser or in the Mac app, with no card. The trial opens every tool, every film stock and Scene Match. During the trial, exported images carry a visible watermark, and LUT and preset export stay locked until a Pro license is active. When the five days end, the editor locks until you take a license.

Pro license

Pro is a license for a set period. The price and the length of that period are the ones shown at checkout; the launch price is announced when Luma Owl opens. One license is for one person, on up to 2 devices, includes the Mac app, and puts no limit on the LUTs and presets you export. It is not a purchase for life: when the period ends you renew it, or the editor goes back to its locked state and your exported files stay yours, as described in section 6.

Beta testers and promoters

If you help us as a beta tester and/or promoting Luma Owl, you get the online version free for a year. We agree it by email after you send the access request; it covers the browser app for twelve months and it can be renewed by agreement. Nothing is billed and you can stop helping whenever you like, in which case the year simply runs out.

Downloadable content

Curated scenes, color packs, film stock data and presets are downloaded through the app and require an active, live license to download new items or update existing ones. Anything you have already downloaded keeps working under the same terms as the rest of your exports and content, described in section 6, even if your license later lapses.

Payments

Payments are processed by our merchant of record, Lemon Squeezy. They handle checkout, card data, invoices and any applicable VAT or sales tax. We never see or store your payment details.

Prices are shown in US dollars unless stated otherwise. Early-bird and promotional prices apply only to the plan and period described at checkout.

05Activation and device limits

  • Up to 2 devices. One Pro license can be active on two devices at the same time. You can deactivate a device from inside the app to free a slot.
  • Online check every 28 days. Luma Owl verifies your license with our license server at activation and then at most once every 28 days. Between checks it works fully offline. If a check cannot complete, the app tells you and gives you time to reconnect before Pro features pause.
  • What is sent. Only your license key and an anonymous device identifier. Never your photos, videos or projects. Details are in the Privacy Policy.
  • Revocation. We may suspend or revoke a license that is being shared, resold, used on more devices than allowed through technical workarounds, or obtained by fraud or chargeback. We will contact you first when we reasonably can.

06What you create is yours

Everything you make with Luma Owl belongs to you. LUTs (.cube, HALD), presets and colour profiles for classic editors, graded photos and videos, and any other export are your work. You can use them in client projects, publish them, give them away or sell them. We claim no rights over them and we never require credit.

The only exception is the software itself and the assets we ship inside it (the film models, the interface, our sample images). Those stay ours. Selling a LUT you graded with Luma Owl is fine. Repackaging Luma Owl's internal film data or code as your own product is not.

Pro exports may carry an invisible purchase fingerprint that links the file to the license that produced it. It does not contain personal data, does not affect image quality and exists only to detect license abuse.

Attribution in exported files. Every .cube LUT, preset and colour profile you export carries a short Luma Owl attribution line, added automatically in the file's header, in its comments, and in the profile's copyright field. This is always on and cannot be switched off. If you hold a paid license and have set up your own signature, it is added alongside the Luma Owl line, not instead of it. This attribution is only a line of provenance: it gives Luma Owl no rights over your file and does not limit your right to use or sell it.

07What you may not do

  • Reverse engineer, decompile, disassemble or otherwise try to extract the source code, film models or license mechanism, except where the law expressly allows it.
  • Share, publish, sell or give away your license key, account or activation, or use one license across a team.
  • Bypass, remove or tamper with the license check, the device limit or the watermark.
  • Redistribute, rent, resell or host Luma Owl, in whole or in part, including modified copies.
  • Present Luma Owl, its film models or its bundled assets as your own product.
  • Use Luma Owl to break the law or to infringe someone else's rights, for example by grading images you have no right to use.
  • Remove copyright notices or the credits shown in the app.

08Trial and watermarks

During the 5-day trial the whole editor is open: every tool, every film stock, Scene Match and the Warper. Exported images carry a visible watermark, and LUT and preset export are not available until a Pro license is active.

A LUT file has no picture on it, so it cannot carry a visible watermark the way an image can. Every LUT instead always carries the attribution line described in section 6. Under an active Pro license, LUT and preset export has no limit.

Watermarked exports are for evaluation only. Do not remove or hide the watermark.

09Updates and support

An active license always includes the latest version of Luma Owl, in the browser and in the Mac app, updates included, for as long as the period you paid for lasts. When the period ends, the editor locks until you renew. We may add, change or retire features over time, but we will not remove a feature you paid for without a comparable replacement.

Support is by email at lumaowl@pm.me. We aim to reply within two working days. There is no guaranteed response time.

10Refunds and cancellation

Try before you pay

The 5-day trial opens the whole editor, in the browser or on the Mac, with no card. Use it to check that Luma Owl works for you before you pay. Because of that, once a license is activated, sales are final: no refund for the period you bought.

License not yet activated

If you have bought a license and have not activated it on any device, write to us within 14 days of purchase and we refund you in full. No forms, no questions. Once the license is activated, the refund window closes.

End of the period

A license runs for the period you bought and stops there. If you chose a plan that renews on its own, you can cancel it at any time before the next period starts, with no penalty and no prorating; your access continues to the end of the period you already paid for. We do not refund a period once it has started.

Checkout consent

Because you can try Luma Owl free first, checkout asks you to tick a box confirming two things: that you want immediate access to the paid content or license rather than waiting, and that you understand this ends your statutory right to change your mind. Consumers in the UK have this right under the Consumer Contracts Regulations 2013, and consumers in the EU under Directive 2011/83/EU, for digital content that is not on a physical medium. Confirming immediate delivery at checkout is what lets us activate your license straight away instead of holding it for 14 days.

Nothing here removes any other right you have under consumer law where you live.

11No warranty

Luma Owl is provided "as is" and "as available". We work hard to make it accurate and stable, but we do not promise that it will be free of errors, that it will work with every camera, file or operating system, that colour output will match any other software or a physical film print, or that it will meet your specific needs. All warranties implied by law are excluded to the extent the law allows.

Film stock names (Kodak, Portra and others) are trademarks of their owners. Luma Owl's film models are independent simulations built from published datasheets and are not endorsed by or affiliated with those companies.

12Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, including lost profits, lost data, lost client work or business interruption, arising from your use of or inability to use Luma Owl.

Our total liability to you for any claim related to Luma Owl is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited under applicable law.

Keep backups. Luma Owl works on copies of your files and never uploads them, but you are responsible for your own originals.

13Termination

You can stop using Luma Owl at any time. We may end your license if you materially break these terms and do not fix it within 14 days of us telling you, or immediately in cases of fraud, key sharing or tampering. When the license ends you must stop using Pro features and delete your copies of the software. Sections 6, 11, 12 and 15 survive termination. Everything you created stays yours.

14Changes to these terms

We may update these terms when the product or the law changes. The date at the top always shows the current version. For material changes we will notify you in the app or by email at least 14 days before they take effect. Continuing to use Luma Owl after that date means you accept the new terms; if you do not, you can stop using Luma Owl and, for the period you already paid for, keep using the version you have under the terms you accepted.

15Governing law

These terms are governed by the law of Scotland. Any dispute will be handled by the Scottish courts, with two exceptions: consumers in the rest of the UK or in the EU keep the protection of their local law and courts, and we may seek an injunction to protect our intellectual property anywhere.

Before going to court, write to us. Most issues are solved in one email.
